The Ministry of External Affairs (MEA) stated that the court was set up in “brazen violation” of the Indus Waters Treaty (IWT), as its formation required mutual consent, which India never provided.
▪️India has never recognised the court’s authority and considers its actions “per se void”.
▪️The supplemental award did not rule on the projects themselves but asserted the court’s jurisdiction to hear the dispute—something India firmly denies.
▪️The Indus Waters Court of Arbitration was established in 1965 with the brokering of the World Bank, in violation of the Indus Waters Treaty of 1960.
▪️Following the April 22 Pahalgam terror attack, India placed the IWT in abeyance, invoking its sovereign rights under international law.
