42वें संशोधन अधिनियम, 1976 में पारित किया गया और 44वें संशोधन बिल, 1978 में प्रस्तुत किया गया, भारतीय संविधानिक इतिहास में महत्वपूर्ण घटनाएं हैं। संक्षेप में तुलना:
### 42वें संशोधन अधिनियम (1976):
1. पृष्ठभूमि:
- आपातकाल की अवधि के दौरान पारित किया गया। (1975-1977)
- इंदिरा गांधी द्वारा प्रस्तुत किया गया।
2. मुख्य परिवर्तन:
- प्रस्तावना में "समाजवादी" और "धर्मनिरपेक्ष" शब्दों को जोड़ा गया।
- राष्ट्रपति के आपातकाल घोषणा करने के संबंधित प्रावधानों में परिवर्तन किया गया।
- राजकीय नीतियों के दिशा-निर्देश के क्षेत्र को बढ़ाया गया।
- न्यायिक समीक्षा के क्षेत्र को सीमित किया गया।
3. विवाद:
- कुशासनी मार्गों में शक्ति को संकेत होने के लिए और न्यायिक स्वतंत्रता को कमजोर करने के लिए बहुत की गई।
### 44वें संशोधन बिल (1978):

- 42वें संशोधन के चर्चा और आलोचना का उत्तर के रूप में प्रस्तुत किया गया।
- मोरारजी देसाई द्वारा प्रस्तुत किया गया, जो जनता पार्टी की अध्यक्षता कर रही थी।
2. मुख्य प्रस्तावना (पारित नहीं किया गया):
- 42वें संशोधन द्वारा बदले गए कुछ संवैधानिक प्रावधानों को पुनर्स्थापित करने की योजना बनाई गई थी।
- मौलिक अधिकारों को मजबूत करने और सरकारी शक्तियों को सीमित करने का उद्देश्य था।
3. परिणाम:

The 42nd Amendment was criticized for diluting the independence of the judiciary and concentrating power in the hands of the executive. Subsequently, some of its provisions were amended or repealed by later amendments.

4. आपातकालीन प्रावधान: अपातकाल लागू करने की अधिकारीयों की शक्ति बढ़ाई गई थी, और "आंतरिक अशांति" को आपातकाल लागू करने का कारण जोड़ दिया गया था।
5. न्यायिक समीक्षा: संविधान संशोधन की न्यायिक समीक्षा की शक्ति को सीमित किया गया था, कहा गया था कि किसी भी अधिविधि को किसी भी कारण पर कोई सवाल नहीं किया जा सकता है।
6. राष्ट्रपति और उपराष्ट्रपति का चयन: राष्ट्रपति और उपराष्ट्रपति का चयन का तरीका बदल दिया गया और चयन में किसी भी निर्वाचन संबंधी रिक्त स्थान के कारण यह चुनौती नहीं की जा सकती थी।
7. राज्य संसदें: राज्य संसदों की कुछ मामलों पर विधायिका बनाने की शक्ति को कम किया गया और इससे संसद को अधिक अधिकार मिला।
42वें संशोधन की आलोचना की गई थी क्योंकि इसने न्यायप्रणाली की स्वतंत्रता को कमजोर कर दिया और क्रियाशीलता के हाथों में शक्ति को एकत्र कर दिया। बाद में कुछ इसके प्रावधानों को बदल या रद्द कर दिया गया।
