1️⃣ Only Bitfinex May Get Restitution In 2016 Hack, Per Government Filing ▶️

According to a filing in the case against Bitfinex hackers Ilya Lichtenstein and his wife Heather Morgan, only the crypto exchange might qualify as a victim under the CVRA [Crime Victims' Rights Act] or for restitution under the MVRA [Mandatory Victim Restitution Act]. It stated that the United States government is unaware of any other parties that qualify. Lichtenstein and Morgan, as well as Bitfinex parent company iFinex, have asserted that the crypto trading platform is the sole victim. For context, this claim comes after Bitfinex spread the loss from the hack across its customer base and reimbursed them itself in 2016.

2️⃣ VanEck to Invest in Early Stage Ventures Including Crypto With New $30M Fund 💰

Global investment management firm VanEck has announced the launch of its new venture capital unit, VanEck Ventures. The investment giant stated the new venture fund will focus on fintech, digital asset or artificial intelligence (AI) companies in pre-seed or seed stages. It is raising $30 million for its first fund. The fund will be led by former Circle Ventures leaders Wyatt Lonergan and Juan Lopez, who aim to make between 25 and 35 investments with check sizes ranging from $500,000 to $1 million. It has already invested in four different projects.

3️⃣ FBI Creates Bogus Crypto To Nab 4 Companies, 14 People On Fraud Charges

Federal prosecutors have reportedly charged four market makers, a handful of crypto projects, and over a dozen individuals with market manipulation and “wash trading” in the digital asset industry. The prosecutors claim the parties profited from fees and selling manipulated coins at elevated values.

According to recently unsealed documents, the four market makers are Gotbit, CLS Global, MyTrade and ZM Quant. The case also involved the international arrest of a few leadership-level members and employees at these market-making firms. According to a statement released by the U.S. Attorney's Office for the District of Massachusetts, four defendants have agreed to plead guilty and more than $25 million in crypto has been seized. The arrests come after the FBI, which was also involved in the investigation, created its own crypto called NexFundAI to find misconduct.

4️⃣ Thai SEC Proposes New Rules for Crypto Investment in Mutual and Private Funds 🔍

The Thai Securities and Exchange Commission (SEC) has reportedly proposed new regulations to allow mutual and private funds to invest in digital assets. The proposal follows growing interest from institutional investors. The SEC published the draft proposal on Wednesday and invited public feedback on revisions to the criteria for funds investing in digital assets. The draft also places different limits on digital asset exposure for various fund types. Retail mutual funds would be restricted to a 15% allocation in crypto investments, while institutional and high-net-worth investors would have no cap on exposure.

1️⃣ Former Bitcoin Dev Peter Todd Denies He's Satoshi Hours Before HBO Documentary Airs 💸

The new HBO documentary "Money Electric: The Bitcoin Mystery" suggested the true identity of Satoshi Nakamoto, the pseudonymous creator of Bitcoin, is an early Bitcoin developer named Peter Todd. However, Todd denied the assertions and stated that filmmaker Cullen Hoback was "grasping at straws" if he's identifying Todd as Satoshi.

In an emailed statement to CoinDesk, Todd stated,

Of course, I'm not Satoshi. It's ironic that a director who is also known for a documentary on QAnon has resorted to QAnon style coincidence-based conspiracy thinking here too.

2️⃣ Crypto.com Sues SEC, Chair Gary Gensler After Receiving Wells Notice ▶️

Crypto exchange Crypto.com has reportedly sued the U.S. Securities and Exchange Commission, Chair Gary Gensler and its four commissioners after receiving a notice that the agency plans to bring an enforcement action against the company. The crypto trading platform claimed the SEC's actions left them "with no other choice" and that the court filing was made "to protect the future of crypto in the U.S."

In a statement published Tuesday, Crypto.com stated,

Our decision to sue the SEC follows our receipt of a Wells notice from the Commission staff, illustrating that the SEC’s unauthorised and unjust regulation by enforcement campaign continues despite bipartisan indications that the next Administration will take a more constructive and effective approach to advancing crypto in the U.S.

3️⃣ Midas Launches Tokenised Products Across Europe With No Minimum Investment ⚡️

Crypto investment firm Midas is reportedly offering tokenised real-world asset (RWA) products tailored specifically to retail investors. Specifically, it announced an expansion in access to its tokenised U.S. Treasury bills (mTBILL) and yield-bearing carry trade products (mBasis) to retail users after acquiring a regulatory green light in Liechtenstein. Both products will reportedly have no minimum investment requirements. Midas also stated that early investors in the mTBILL and mBasis products can participate in an incentive program to maximise their investment returns. The first 100 holders of mTBILL and mBasis will earn 50% APY for a limited time, which will be paid in USDC stablecoin.

4️⃣ Ethereum Layer 2 Scroll Debuts Plans To Airdrop SCR Governance Token ✈️

Scroll, a zkEVM Ethereum Layer 2 network, has confirmed plans to launch its governance token to support the blockchain. The token, SCR, will reportedly launch on the Binance Launchpad. The project claimed this was its "first step towards decentralisation."

The team claimed SCR would be used primarily as a primary governance token before progressing to being a protocol utility token as Scroll becomes more decentralised. A total of 1 billion SCR tokens will eventually enter circulation, with 15% reserved for at least two planned community airdrops over the next 18 months. An additional 25% will go toward funding projects building on Scroll, while 20% will be allocated between the Scroll DAO Treasury and Scroll Foundation. The remaining 40% will be divided between investors and contributors, with a split of 17% and 23%, respectively.

1️⃣ Robinhood Chief Legal Officer Dan Gallagher In Running To Lead SEC If Trump Wins Presidency ⚡️

According to a Politico report, Robinhood Chief Legal Officer Dan Gallagher could be the next U.S. Securities and Exchange Commission chair if former President Donald Trump wins the presidential election in November. The report cited “a dozen former top regulators, lobbyists and securities lawyers” as its source.

Gallagher has had a long career. He served as a Republican SEC commissioner from 2011 to 2015. Before that, he was counsel to SEC Commissioner Paul Atkins and also worked on issues involving the SEC's enforcement division and trading division. He became the CLO at Robinhood in 2020.

2️⃣ Vitalik Buterin Donates $182K To Help Fight Airborne Diseases After Receiving Billions Of Moo Deng Memecoin Tokens 💰

Ethereum co-founder Vitalik Buterin has reportedly donated $182,000 worth of ETH to the biotech charity Kanro. The donation funds come from Buterin selling billions of the Moo Deng memecoin tokens that people sent him. Notably, Buterin recently stated that any memecoins sent to him would go to charity. He added that users should either send the tokens to charity directly or create a DAO so that people can have a better say in where their money goes.

3️⃣ Bitget Will Repay Traders After Ethereum Token Plunges 52% in Flash Crash 🔽

Crypto exchange Bitget’s Ethereum-based BGB token lost more than half its value on Sunday in a sudden "flash crash." The token plunged roughly 52% to $0.54 from $1.14 at around 10:30 pm ET on Sunday before recovering most of its value within an hour. Bitget attributed the flash crash to “unexpected volatility” in the crypto market. It has promised to compensate holders who suffered losses during the flash crash. It will reportedly issue a repayment plan to BGB holders in 24 hours, completing the compensation process in 72 hours.

4️⃣ Over $5 Million In Crypto Stolen From Coinbase Users In Alleged Recent Social Engineering Scheme: ZachXBT ▶️

Blockchain sleuth ZachXBT has reportedly helped recover about $275,000 worth of cryptocurrencies for a Coinbase customer who was a victim of a social engineering scheme. ZachXBT also claimed to have found evidence of $5 million in additional stolen Bitcoin and Ether tokens related to the same alleged scam while investigating this fraud. While it is not yet clear how the stolen funds were frozen, ZachXBT stated that the Coinbase customer, an elderly person, held funds on a Ledger hardware device and was convinced to move them after scammers said their exchange account was compromised.

5️⃣ Delaware Judge Approves FTX Estate’s Bankruptcy Plan ✔️

United States Bankruptcy Judge John Dorsey reportedly approved FTX’s bankruptcy plan on Monday. The plan will see the majority of the crypto exchange’s customers get the equivalent of their 2022 losses, and then some.

Lawyers for the estate claim that customers can expect to receive cash repayments worth an average of 118% of the value of their holdings at the time FTX filed for bankruptcy in November of 2022, though some could get up to 140%. While this is more than what creditors expected to receive two years ago, the funds will not match the gains BTC and other cryptocurrencies saw during FTX's bankruptcy.

Metaplanet, a publicly listed Japanese investment adviser, has reportedly purchased an additional 108.786 BTC valued at 1 billion yen ($6.7 million). Notably, the latest purchase has brought the company’s total BTC holdings to 639.503 BTC, valued at $40.6 million. The latest purchase was made at an average price of 9.19 million yen ($61,880) per BTC, bringing its average purchase price for its BTC holdings to 9.32 million yen ($62,789).

1️⃣ ‘Uptober’ Builds Strength As Bitcoin Held On Exchanges Falls To 6-Year Low 🕯

Data from CryptoQuant shows that there are just a little over 2.8 million BTC held on centralised exchanges. Notably, this is 500,000 BTC less than the amount seen in March. It is also the lowest BTC exchange balance since November 2018. A low BTC balance on centralised exchanges typically results in decreased amounts of available liquidity, which often leads to bullish price movements. Analysts believe this strengthens the case for a fourth-quarter “Uptober” rally for Bitcoin.

2️⃣ Coinbase to Delist Unauthorised Stablecoins in EU by December

Crypto exchange Coinbase reportedly plans to de-list any unauthorised stablecoins in the European Union by December 2024. This move is part of the exchange’s compliance strategy with the EU's Markets in Crypto Assets rules (MiCA) which is set to be fully implemented in December. Specifically, MiCA requires stablecoin issuers to obtain e-money authorisation in at least one member state. Coinbase has also stated that it will provide more details about a transition plan in November. This plan is expected to help its European customers switch to compliant stablecoins, including USDC and EURC.

Gaming giant Ubisoft is reportedly launching a 10,000-piece NFT collection on the Ethereum scaling network Arbitrum. The NFTs, which will sell on the Magic Eden NFT marketplace, will provide holders with early access to the studio’s upcoming top-down shooter Captain Laserhawk: The G.A.M.E. The competitive multiplayer game promises to include iconic characters from Assassin’s Creed, Rayman, and Beyond Good & Evil. The NFT will also reportedly allow holders to participate in the game's governance model, and track player progress. As the player’s score increases, the NFT evolves, unlocking new perks and increasing their governance influence.

4️⃣ EigenLayer Says $5.7M Hack ‘Isolated’ Incident, No Vulnerability On Protocol 🔓

Earlier today, the EigenLayer team posted a tweet claiming they were looking into “unapproved selling activity” after a wallet ending in “f10D” sold approximately $5.5 million worth of EIGEN tokens. While the team initially suspected it to be an insider or early investor potentially contravening the token lockup period, an update posted later in the day claimed the unapproved token-selling incident was due to a hack.

Specifically, the EigenLayer team claimed a malicious attacker compromised an email thread involving an investor’s token transfer into custody. This reportedly led to the team sending the investor’s 1.6 million tokens to the attacker. The attacker has since converted the stolen EIGEN tokens into stablecoins which were sent to centralised exchanges. The team has communicated the incident to the concerned platforms and authorities. The team has also assured users that the incident was isolated and did not affect its broader ecosystem. It claimed the compromise was not related to any onchain functionality.

According to British multinational bank Standard Chartered, SOL is projected to outperform ETH and BTC in 2025. Specifically, Geoffrey Kendrick, Global Head of Digital Assets Research at Standard Chartered, predicts a fivefold increase in SOL’s price, a fourfold increase in ETH’s price, and a threefold increase in BTC’s price if Donald Trump wins the U.S. presidential election. However, the outlook changes under the Kamala Harris administration. He claims that he expects BTC to outperform ETH and ETH to outperform SOL in 2025 if Harris wins. Explaining the logic, Kendrick states that he views a Trump administration as being more supportive of the broader crypto ecosystem (including Solana) compared to a Harris administration. He also expects Bitcoin to hit $200,000 by the end of 2025, irrespective of who wins the election.

6️⃣ FTX Says Caroline Ellison To Give Up ‘All Of Her Assets’ In Settlement 💰

Caroline Ellison, the former co-CEO of Alameda Research, has reportedly agreed to turn over the bulk of her assets to FTX debtors in an effort to settle a lawsuit filed against her by the FTX bankruptcy estate. Specifically, Ellison has agreed to transfer any assets not forfeited to the government in her criminal case or used for legal fees to FTX creditors. The motion for approval, filed on Oct. 7, claims that “Ellison will have no remaining assets other than certain physical personal property,” once she complies with the settlement agreement. However, it did not specify the value of the assets she would forfeit. A hearing on the proposed settlement is scheduled for Nov. 20.

According to a recent press release, the crypto-friendly neobank Revolut has blocked up to $13.5 million worth of “potentially fraudulent crypto transfers” over the past three months. It stated that the company’s “proactive approach” has led to an increase in the amount of potential customer losses it has prevented from such fraudulent crypto transfers. Woody Malouf, the company’s head of financial crime and fraud estimated that the platform saved customers more than $590 million in potentially fraudulent transactions in 2023. He stated that such potential fraud cases include schemes like celebrity endorsement scams, deepfakes and artificial intelligence-generated scams.

1️⃣ Russian 'Evil Corp' Group Hit With Sanctions After $100 Million in Ransomware Thefts ▶️

Evil Corp, a Russia-based cybercrime syndicate allegedly responsible for widespread financial theft and ransomware attacks, has reportedly been hit with sanctions from law enforcement agencies in the U.S., U.K. and Australia. Specifically, the agencies jointly imposed sanctions on key members of the group. The U.S. Department of Justice also simultaneously unsealed an indictment charging an Evil Corp member with deploying BitPaymer ransomware against victims in the United States. Evil Corp is also known for developing and distributing the Dridex malware, which has led to over $100 million stolen from hundreds of banks and financial institutions across more than 40 countries.

2️⃣ Solana Dev Quits Project He Set Himself on Fire to Pump

Mikol, the creator of the Truth or Dare (DARE) memecoin, has reportedly decided to quit the project. For context, Mikol performed live-streamed stunts to help pump his DARE token. He made headlines after setting himself on fire as a dare and was hospitalised with third-degree burns. Mikol told Decrypt last week that the only regret he has is not cashing out when he had the opportunity. He also stated that only two team members have remained in contact with him since the fiery incident. He claimed the rest “took their money and left,” including the unidentified “close friend” who came up with the idea to set him ablaze.

3️⃣ U.S. Moves To Seize $2.7 Million From Lazarus Hacks Traced Through Tornado Cash, Other Mixers

The U.S. Justice Department has reportedly filed two forfeiture actions to begin seizing more than $2.67 million worth of cryptocurrency stolen by the North Korean Lazarus hacking group. Specifically, the US government seeks to recover approximately $1.7 million in USDT stolen by the organisation in the 2022 Deribit hack and roughly $970,000 in Avalanche-bridged-Bitcoin (BTC.b) stolen by the organisation in the 2023 hack of the Stake.com gambling platform.

4️⃣ New Ethereum Proposal Aims to Increase Throughput By 50% ⚡️

Ben Adams, the co-founder of Illyriad Games, has reportedly introduced a new Ethereum Improvement Proposal (EIP) that would slash block times on Ethereum and increase data capacity to boost overall throughput by 50%. Specifically, the proposal, titled EIP-7781, aims to slash block times on Ethereum from 12 seconds to 8 seconds – this is a 33% decrease. Pseudonymous developer Cygaar described EIP-7781 as the “first huge” step toward improving the base layer of the Ethereum network. Ethereum Foundation researcher Justin Drake also approved of the EIP on GitHub. He stated that its immediate proposal aligned with some of the broader goals proposed by Ethereum co-founder Vitalik Buterin.

On its 10th anniversary, stablecoin issuer Tether announced that it will release a documentary on USDT and its impact on fighting inflation. In its trailer, Tether presented interviews with users from Turkey, Brazil and Argentina who have benefited from the stablecoin as they attempt to combat inflation in their respective countries. The United Arab Emirates Federal Tax Authority (FTA) has reportedly published amendments to the country’s value-added tax (VAT) rules that impact the tax treatment of digital assets such as crypto. Specifically, the amendments to the VAT regulations in the UAE will exempt VAT applications for the transfers and conversions of digital assets. The business consultancy company PwC noted that the exemptions in the transfer and conversion of virtual assets will be applied retrospectively from Jan. 1, 2018.

As for the web3 functionality, Durov teased that limited-edition Gifts can be converted to TON-based NFTs in the future. Once converted, the limited-edition Gifts can be used outside of Telegram.

Toy manufacturer LEGO Group has reportedly removed a "LEGO Coin" token scam that briefly appeared on its homepage after being hacked yesterday. According to screenshots on social media, the scam attempted to attract buyers by promising “secret rewards” to purchasers LEGO Coin. Anyone who clicked the “Buy Now” button was reportedly taken to a phishing site. LEGO reportedly told consumer tech product platform Engadget that no user accounts were compromised due to the scam’s ‘brief’ appearance.

Crypto exchange Coinbase has reportedly asked the judge presiding over its battle with the SEC to reconsider an interlocutory appeal filed on behalf of the exchange in April 2024. The interlocutory appeal requested that the Second Circuit of Appeals be allowed to review a key question in the case: how the Howey Test, the traditional standard for what counts as a security based on a 1946 Supreme Court ruling, applies to digital assets. The latest filing to reconsider the interlocutory appeal comes after the SEC's recent appeal in its case against Ripple

Coinbase stated,

The SEC has conceded, and now reconfirms by its appeal in Ripple, that the issues presented by Howey’s application to secondary-market digital asset transactions are of 'industry-wide significance. Prompt and complete appellate review is urgently needed.

The International Monetary Fund (IMF) has reportedly reiterated its recommendation for El Salvador to narrow the scope of its Bitcoin law and overhaul its regulatory framework surrounding the digital asset. IMF spokesperson Julie Kozack also stated that the IMF recommended El Salvador limit public sector exposure to Bitcoin. The recommendations were made during a press conference on Thursday. Kozack also stated that the IMF aims to reach an agreement with El Salvador on a new IMF-supported program that would “help with macroeconomic stabilisation and adjustment and also growth-enhancing reforms.”

5️⃣ No, A CryptoPunks NFT Didn’t Just Sell for $56 Million 🔍

According to a Decrypt report, a CryptoPunks NFT holder used flash loans to trick the market into thinking the NFT sold for a record $56.3 million earlier today. The article notes that CryptoPunk 1563, which was last purchased for about $69,000 worth of ETH in September, is a ‘floor’ punk – i.e., it does not have any particularly rare attributes. It then cites on-chain data which shows that the purchase was conducted via a flash loan facilitated by the DeFi protocol Balancer. Specifically, the “buyer” of the NFT took out a 24,000 ETH loan from Balancer, and the “seller” paid back this loan to Balancer, within the same transaction. While no one made any money, the entity behind this transaction paid network fees to execute the stunt.
