❗️Юридический ликбез: Где кончаются законы РФ и начинается австралийская территория? 🇦🇺🇷🇺🗳

Посольство РФ в Канберре выпустило предупреждение об агитации и австралийской полиции. Давайте разберем, как это работает на практике, опираясь на нормы международного и избирательного права.

1. Инфраструктура и поддержка граждан Чтобы голосование проходило комфортно, пророссийские активисты и казаки-добровольцы организуют полевую кухню, биотуалеты и зоны отдыха за пределами территории дипмиссии. Можно сказать, что казаки - а не полиция будут контролировать обстановку перед избирательным участком. Это частная инициатива граждан, создающая нормальные условия для тех, кто стоит в очередях. Полиция вмешиваться вряд ли будет.

2. Чья юрисдикция и где действует запрет на агитацию?

Посольство напоминает про запрет агитации в день голосования. Однако важно понимать границы правового поля:

На территории избирательного участка (в здании Посольства/Генконсульства): Действует российское законодательство (ст. 49 ФЗ № 67-ФЗ «Об основных гарантиях избирательных прав...»). Здесь агитация строго запрещена, а порядок обеспечивает участковая избирательная комиссия (УИК).

За пределами "fence" (на территории Австралии): Российские законы не действуют. Вся территория за воротами — это юрисдикция австралийского государства.

3. Инцидент на выборах 2024 года на выборах Президента РФ в 2024 году произошел характерный случай: представитель Генконсульства (Аржаев) выбежал за пределы избирательного участка № 8010 на австралийскую улицу и начал в грубой форме требовать у прохожих свернуть баннеры в поддержку Президента РФ В.В. Путина.

С точки зрения Венской конвенции о дипломатических сношениях 1961 года и местной юрисдикции, сотрудники консульства не имеют правоохранительных полномочий за пределами территории дипмиссии.

4. Роль австралийской полиции как справедливо отмечено в объявлении посольства, порядок вокруг места проведения голосования контролирует австралийская полиция.

На австралийской земле действуют законы штата (NSW/ACT).
Общественные акции, баннеры и пикеты на улицах австралийских городов регулируются местным законодательством о публичных собраниях, а не Избирательным кодексом РФ.

❗️The House passed H.R. 5334, the "Lindsey O. Graham Sanctioning Russia and Iran Act of 2026," 262–159, with Senate amendments.

The Senate previously passed it 86–11 in August. The bill sanctions Russian entities, extends Iran sanctions by five years, and authorizes up to 100% tariffs on top Russian energy buyers.

Bill now heading to Trump's desk.
